Studies, tests, examination activities and practical measures which refer to a reference medicine to the extent that these are necessary for obtaining a approval for the sale of a medicine;

Preparation in pharmacies of medicines in accordance with a prescription by a physician in an individual case.

Limitations on exclusivity

From the design right are excluded acts of exploitation:

that are carried out privately and for non-commercial purposes;

that are carried out for experimental purposes;

that imply reproduction for the purposes of quotation or teaching.

Limitations on exclusivity

A third party may in the course of trade use: his or her trade name, name or address; indications concerning the kind, quality, quantity, intended purpose, value, geographical origin or other characteristics of the goods or service, or the time of production of the goods or rendering of the service; the trade symbol, if it is necessary to indicate the intended purpose of the product or service, in particular as accessories or spare parts.
